What Information Do We Collect?

When you use or interact with our Services, we may collect Information about you in the following ways:

Information you provide to us : When you use or interact with our Services, we may collect certain Information from you. For example, we may collect your Information when you make a purchase on our Site; create an account on our Site; sign up for our newsletters; participate in our promotions or sampling programs; enter into our sweepstakes and contests; complete our surveys, quizzes or questionnaires; submit a product review; interact with the Site’s “Chat” feature; participate in our product affinity groups or loyalty programs; apply for employment with us; interact with us at trade shows or lunch ‘n learns; or submit a complaint, comment or question to us. Such Information may include:

Name and contact information: such as your name, your company name (if applicable), and your contact information (e.g., postal addresses, e-mail addresses or telephone numbers).

Account information: such as your login credentials (including your username, password, security questions and answer) and account number, your preferences (e.g., marketing preference, communication preference), and account activity (e.g., points earned or redeemed in connection with purchases, discounts applied, referrals made regarding our products or brands, and other point earning actions, such as following or liking our products or brands on social media platforms) if you maintain an account and/or participate in one of our Loyalty Programs, Sampling Programs or Promotions.

Demographic data: such as your age or month and year of birth, gender, or race or nationality.

Payment, transaction, and shopping information: such as your credit card and other payment information, records of the products you view, add to your wish list, add to your cart, order, or purchase, and returns or exchanges of our products or other transactions.

Health-related information: such as your dietary preferences and other health-related information you may provide in connection with a product claim or otherwise. In certain jurisdictions, the health-related information we collect may constitute consumer health data (as defined by applicable law). Professional or employment related information: such as your job history, education information, certifications, and other information you may provide in connection with your job application.

Reviews and public forum comments : information you choose to provide in reviews of our products or comments you post in public sections of our Sites. (Please note that any information posted in these sections will be available to the public, you should be mindful when making such posts and do not post any personal or other information you would not want shared with the public.)

Government-issued identifiers: such as your driver’s license number, Social Security number, or other government-issued identification numbers in connection with your job application.

Video and audio information: such as videos or CCTV recordings through our security cameras when you visit our locations, video recordings or photographs of our events or programs (e.g., our trade shows or lunch ‘n learns), or voicemails you may leave us.

Other information: any other Information you may choose to provide, such as your interests and hobbies, and Information you provide when you communicate with us (e.g., contents of your email, voicemails, text/SMS messages, chat messages, or other communications).

In certain circumstances, you may provide us information regarding other individuals, such as when you use the “tell-a-friend” tool provided on our Sites, when you refer our product to another person as part of our Loyalty Programs, Sampling Programs or Promotions, when you e-mail information about our products and offerings to another person, or make purchases on our Sites as gifts for another person. When you use these offerings, we may ask you for the name and contact information of the other person.

Automated collection of Information: When you visit or interact with our Sites or interact with our email communications, we may collect certain Information about you and your devices by automated means, using cookies, pixel tags, web server logs and other technologies. For more information regarding such technologies, please refer to the “ Cookies and Other Technologies ” section below. The Information we collect in this manner may include:

Device information: such as your device ID, unique device identifier, web browser characteristics, device characteristics, operating system, and language preferences.

Internet or other network activity information: such as your IP address, your browsing history, search history, and your purchase or transaction history on our Sites.

Geolocation data: such as your general location. We do not collect precise location data.

Clickstream data: such as information regarding your interactions with our Sites or email communications, including the referring URLs, the URLs you visit when leaving our Sites, the pages, content or ads viewed, the links clicked, items downloaded, dates and times of Site visits and/or account access, your interactions with our “Chat” feature (if any), or other usage activity.

Information from third parties: We may receive or otherwise obtain Information about you through third parties, such as third parties that perform services for us or on our behalf, publicly available sources, and other third parties. Such Information may include:

Publicly available information: such as information from databases, registers, media search results and other public sources.

Social media data: such as comments, content, or details that you post on publicly available websites or social media platforms, including any information that accompanies those posts, such as your name, username, email address, your likes or preferences, or profile picture, subject to your privacy settings on these platforms and/or websites.

Background check information and references: such as information collected in connection with background checks or employment references in connection with your job application.

How is Your Information Used?

We may use the Information we collect from and about you listed above for various purposes, including:

Provision of our Services: We use your Information for the provision of our Services, including processing and fulfilling your purchases, returns, exchanges or other transactions; maintaining, managing, and administering our Sites and your accounts (including enabling users to use our Sites and their features, customizing our Sites to your interests, choices, or preferences, providing technical or other support to resolve technical issues); and performing data analytics (such as analyzing our products, services, and Sites).

Operate our business: We use your Information to support our internal business functions, including performing accounting, auditing, billing, reconciliation, and collection activities.

Maintenance of the security of our systems: We use your Information to verify your identity and to maintain the integrity and security of our systems and Services.

Communications: We use your Information to communicate with you, including responding to your requests, questions, and concerns; sending you notifications related to your account, purchases, exchanges, returns or other transactions; communicating with you about our and others’ products, services, and events that we think might interest you; and managing our relationship with you.

Administration of our sweepstakes, contests, and other promotional programs: We may use your Information to administer and/or attend to our sweepstakes and contests, including communicating with contests or sweepstakes entrants and winners; and administer/attend to other promotional programs, such as our Loyalty Programs, Sampling Programs and Promotions (each as defined in the U.S. State Supplement ).

Marketing and advertising purposes: We may use your Information to conduct market research; send you promotional materials that we think may be of interest to you; tailor ads displayed to you on third-party websites to your interests and interactions with our Services; and determine and manage the effectiveness of our advertising and marketing (including counting and verifying positioning and quality of ad impressions).

Improvement of our Services: We may use your Information to develop new features and offerings on our Sites. This includes using your Information to detect, prevent, and respond to technical issues, bugs, or errors within our systems. By analyzing feedback and error reports, we can enhance the functionality and reliability of our Services to better meet your needs.

Protecting our interests: We may use your Information when we believe it is necessary to take precautions against liabilities; investigate and defend ourselves against any claims or allegations; protect our rights and property; recover debt; protect against and prevent fraud, unauthorized transactions, claims, or other liabilities; and enforce our policies and terms (including the Terms and Conditions of our Sites).

Talent Management and Recruiting Purposes: We may use your Information to manage career opportunities; assess and/or process your job application(s); communicate with you about the recruitment process; and make a decision about recruitment or appointment.

Compliance with law: We use your Information to comply with applicable legal and regulatory requirements and industry standards; detect and prevent fraud, crime and/or corruption; investigate violations; and as otherwise required by applicable law, regulation, or other governmental authority, including to comply with a subpoena or similar legal process.

Other purposes: We may use your Information for other purposes for which we provide specific notice at the time of collection. We also may use your Information with your consent or at your direction.

Deidentified and Aggregated Information: We may aggregate and/or de-identify your Information such that it is no longer able to be linked to you or your device(s). This Notice does not limit our ability to use or disclose such aggregated or de-identified information, which we may disclose, in our sole discretion, to third parties for their own use. To the extent we process deidentified information, we will maintain and use the information in deidentified form and will not attempt to reidentify the information unless permitted by applicable law.

To Whom Do We Disclose Your Information?

We may disclose the Information we collect from and about you listed above to the following affiliates and third parties in the following ways:

Our Affiliates: our affiliated companies and brands in connection with any of the uses set out in this Notice.

Service Providers: our service providers who provide services to us or on our behalf, such as services related to website hosting, data analytics, email marketing and IT infrastructure. For example, some of our stores are hosted on Shopify, who may process your Information to help us operate our stores.

Advertising Partners: our third-party advertising partners (including advertising networks, online advertising companies, and social media and networking platforms) who may use such information for their own purposes, including to market products or services to you or tailor ads displayed to you on third-party websites to your interests and interactions with our Services.

Business Partners: our business partners, including our co-sponsor(s) or other strategic partners, who may use such information for their own purposes. For example:

If we obtain your Information in connection with a contest, sweepstake, offering, or other promotional activity that is jointly offered by us and other third parties, we may share your Information with such third parties.

We may disclose your Information to Shopify as part of Shopify’s enhanced services, pursuant to which Shopify may use and/or disclose Information collected across Shopify stores with other third parties to offer tailored features or content and for Shopify’s other business purposes. You may ask us not to share your Information with our business partners as described in the “Your Rights and Choices” section below.

Public : if you post a review, comment or other content in publicly available portions of our Sites, any Information you include in this content will be available to the general public. (As noted above, you should be mindful when posting a review, comment or other content to avoid including personal or other information you would not want to share with the public.)

Legal Rights or Obligations: where we believe disclosure is necessary to protect our rights or property, protect your safety or the safety of others, investigate fraud or respond to a government, judicial or other legal request, or to comply with our legal obligations.

Credit Bureaus: credit bureaus, such as in the event of late payments, missed payments, or other defaults on your account.
